Negotiation and mediation are sometimes the best alternative to a court decision or arbitral award and enable to produce win-win innovative solutions for all parties.

We assist our clients in the conduct of informal negotiations or of structured mediation proceedings. We explain and facilitate the process and assist our clients in putting together a creative, flexible and consistent strategy while safeguarding their interests in proceedings being run in parallel or that may be initiated in the future.

Our experience includes:

  • Assisting an Italian group specialised in wind energy in an ICC mediation relating to the management of wind farms (dispute with Spanish shareholder)
  • Assisting a Swiss hotel group in an ad hoc mediation relating to the management contract for a luxury hotel in North Africa
  • Negotiating a settlement agreement on behalf of a European leader in the aeronautical field following the termination of a contract with a US Company for the supply of aerodynamic equipment
  • Negotiating a settlement agreement with a liquidator on behalf of an Italian company in receivership specialising in maritime transport
  • Representing an African player operating in the field of high-speed Internet connectivity in an ICC mediation with a European data center owner following the termination of a service contract
